Bristol-Myers, Sanofi Win Trial, Block Generic Plavix |

Bristol-Myers Squibb Co. and Sanofi- Aventis SA won a court ruling upholding the patent for the blood- thinner Plavix, blocking generic competition to the world's third-biggest selling medicine.
Bristol-Myers shares surged 4.2 percent. U.S. District Judge Sidney Stein in New York federal court rejected arguments by a Canadian generic-drug maker, Apotex Inc., that the patent on the compound is invalid or unenforceable. Apotex has pledged to appeal any adverse ruling.
Apotex ``failed to prove by clear and convincing evidence that'' the patent covering Plavix ``is invalid or unenforceable,'' Stein wrote in an 82-page opinion today. Bristol-Myers and Sanofi are ``entitled'' to a permanent order blocking Apotex from infringing the patent, he wrote.
